The individual named below (referred to as “I” or “me”) desires to participate in volleyball training (the “Activity”) provided by G3 Volleyball Training, LLC, an Alabama limited liability company with facilities located at 182 County Rd 265, Ste 1102, Alabaster, Alabama 35007 (the “Company”). In consideration of being permitted by the Company to participate in the Activity and in recognition of the Company’s reliance hereon, I agree to all the terms and conditions set forth in this instrument (this “Release”). Dangerous Activity. I, THE ATHLETE/PARENT/GUARDIAN, UNDERSTAND THAT VOLLEYBALL INVOLVES A TEST OF A PERSON'S PHYSICAL AND MENTAL LIMIT AND CARRIES WITH IT THE POTENTIAL FOR PROPERTY LOSS, MINOR INJURY, SERIOUS INJURY, AND DEATH. WITH A COMPLETE UNDERSTANDING OF THE POTENTIAL RISKS, I HEREBY ASSUME THE RISKS OF PARTICIPATING/HAVING MY CHILD PARTICIPATE IN VOLLEYBALL AND TRAINING EVENTS, INCLUDING LESSONS, CLINICS, WORKOUTS, PRACTICES, AND ANY OTHER ACTIVITIES. I FURTHER ACKNOWLEDGE THAT ANY INJURIES THAT I SUSTAIN MAY RESULT FROM OR BE COMPOUNDED BY THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF THE COMPANY. NOTWITHSTANDING THE RISK, I ACKNOWLEDGE THAT I AM KNOWINGLY AND VOLUNTARILY PARTICIPATING/HAVING MY CHILD PARTICIPATE IN THE ACTIVITY WITH AN EXPRESS UNDERSTANDING OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE ARISING FROM MY PARTICIPATION IN THE ACTIVITY, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF THE COMPANY OR OTHERWISE. Liability Release and Waiver of Claims. I, the athlete/parent/guardian, herby take the following actions for myself, my executors, administrators heirs, next of kin, successors, and assigns: (a) I hereby waive, release, acquit, and forever discharge G3 Volleyball Training, LLC and its officers, owners, and directors, collectively and individually, and adult supervisors and any and all persons directly or indirectly associated with G3 Volleyball Training, LLC and each of them (collectively, the “Releasees”) from any and all acts, causes of action, claims, demands, damages, costs of expenses on account of or which may in any way develop out of any and all known and unknown personal injuries or property damages which the athlete/parent/guardian may suffer during the course of or as a result of the Activity including, but not limited to, lessons, clinics, workouts and such other activities including travel to and from facility located at 182 County Rd 265, Ste 1102, Alabaster, Alabama 35007, whether arising out of the ordinary negligence of the Company or any Releasees or otherwise; (b) I covenant not to make or bring any such claim against the Company or any other Releasee, and forever release and discharge the Company and all other Releasees from liability under such claims. Indemnification. I the athlete/parent/guardian shall defend, indemnify, and hold harmless the Company and all other Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorney fees, fees, the costs of enforcing any right to indemnification under this Release, and the cost of pursuing any insurance providers, incurred by/awarded against the Company or any other Releasees arising out of or resulting from any claim of a third party related to participation in the Activity, including any claim related to my own negligence or the ordinary negligence of the Company. Photo/Video Release. Athletes involved in any activities offered by G3 Volleyball Training may be photographed or videotaped during training. The undersigned hereby consents to the use of these photographs and/or videos without compensation, on the G3 Volleyball Training Website or in any editorial, promotion, or advertising material produced and/or published by G3 Volleyball Training. Entire Agreement. This Release constitutes the sole and entire agreement of the Company and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. Severability. If any term or provision of this Release is deemed to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Release or invalidate or render unenforceable such term or provision in any other jurisdiction. Successor and Assigns. This Release is binding on and shall inure to the benefit of the Company and me and our respective heirs, successors, and assigns. Governing Law. All matters arising out of or relating to this Release shall be governed by and construed in accordance with the internal laws of the State of Alabama without giving effect to any choice or conflict of law provision or rule (whether of the State of Alabama or any other jurisdiction). Any claim or cause of action arising under this Release may be brought only in the federal and state courts located in Shelby County, Alabama and I hereby consent to the exclusive jurisdiction of such courts. If the athlete is under 19 years of age, a parent/guardian must sign this Release on behalf of the minor. *If the athlete is under 19 years of age, I hereby acknowledge that I am the lawful parent and/or guardian of my child's activities in volleyball or training; if she/he becomes ill or sustains an injury I hereby authorize you to obtain emergency medical/dental care and agree that I will assume financial responsibility for the bills incurred.
